Creating a cat club is not a tricky business. Anyone can do it. The problem is only one: how to create a club officially. The club can have one of the following statuses: city, inter-regional, all-Russian or international. The main task is to determine the legal form of ownership of the club.

There are two main types: commercial and public (non-profit). Of course, if you choose a commercial one, you will automatically be able to foresee any surprises (for example, in terms of the election of governing bodies, etc.), but a heap of taxes will fall on you that you are unlikely to be able to pay, in addition, this money to you and you yourself will need to develop your club. Commercial organizations carry out their activities in accordance with the applicable legal acts of the Russian Federation.

If you choose the most common form - public, you should know that it will be a voluntary, self-governing and non-profit formation based on the principles of collegiality and the election of all bodies. Public associations carry out their activities in accordance with the Federal Law "On Public Associations" 82-FZ of 05.19.95 and the Civil Code of the Russian Federation.

The next stage is the registration of the club. For registration, a standard package of documents is usually provided: a statement of the established form, a charter in two copies, an extract from the minutes of the constituent assembly in triplicate, containing information about the establishment of an organization (club), approval of the charter and the formation of governing and audit bodies, information about founders (they must be at least three and they must be at least 18 years old), a document on the payment of the registration fee, a document confirming the provision of a legal address (this can be open and non-residential premises), protocols of constituent congresses of structural divisions for international, all-Russian or inter-regional status. Documents are submitted for state registration within three months from the date of establishment of the organization. Registration of city and interregional organizations is carried out by the Department of Justice of the city or region in the territory of which the club is being created. The registration of all-Russian and international organizations is carried out by the Ministry of Justice of the Russian Federation, and it is much more difficult to register an organization with an all-Russian status than with an international one. An organization applying for all-Russian status should have its structural units in the territory of more than half of the constituent entities of the Russian Federation, i.e. not less than in 45 subjects of the Russian Federation.

The next step is entering your organization in the Unified State Register of organizations and enterprises of all forms of ownership (EGRPO), and you can do this by registering with the State Statistics Committee of the Russian Federation. Then, within a month, you must register with the tax office, and we are not kidding. By accepting money, not having a tax inspection and not having a checking account, and also not reporting, you can easily substitute your newly made club for closure, and for the leader this can end in a criminal case. So do not tempt fate and do not rely on chance.

Hiding behind the Federal Law on Public Associations, you can not register your cat club, but in this case you do not have the right to conduct financial and economic activities and also doom yourself to constant attacks from a competing organization. Previously (and indeed even now), many cat clubs did not have official registration, but some of them had thought better of it, or rather, were in a hopeless situation. Now they have passed official registration in all necessary instances. Also, one of the options is to join some large organization that will take on all obligations to the state for you.

Nurseries do not need state registration or licensing. To open your own nursery, you must first determine the breed, secondly, get the first animals, and thirdly, join any of the existing clubs and apply there. Next, the club, working on one of the international systems, will forward the application to the central office of the organization, where experts will check the name chosen for the nursery for uniqueness, and within a week can assign the nursery official status.

The owner does not even need to create a legal entity or register as an individual entrepreneur: in the eyes of Russian legislation, the purpose of his activity is not to make profit on a regular basis. For this reason, legal relations with clients and taxation in this area are not regulated.

Often, nursery owners are hesitant to conclude an agreement with a client when buying a kitten or not, because if you conclude an agreement, you need to pay 13% personal income tax on the sale. Sometimes, nursery owners, when transferring kittens to the hands of new owners, draws up an agreement on transfer of rights to property or a gift agreement (tax rate is 13%), but still most of them prefer to do without documents.

Some factories raise the issue of whitening their incomes and introducing nurseries into entrepreneurial activity. But so far this question remains open.

In accordance with the Civil Code of the Russian Federation, animals are property, although the general rules on property apply to them with some reservations (part 1 of article 137 of the Civil Code of the Russian Federation). It is customary for lawyers to say that an animal is an animate thing. Therefore, a cat can be sold, gifted or exchanged.

At the federal level, there are no documents on the protection of animal rights. The only exception is article 137 of the Civil Code of the Russian Federation: cruelty that is contrary to the principles of humanity and article 245 of the Criminal Code, which provides for responsibility for a heartless attitude to animals, are not allowed in the exercise of property rights in relation to an animal. But responsibility under this article only occurs if the animal’s tormentor has hooligan or selfish motives, applies sadistic methods, or performs his actions in the presence of minors. Neither content in crowded conditions, nor savage methods of training, nor other cases of inhuman treatment can be the basis for contacting the police with a complaint about the torturer, while the animal is alive and well. In fact, criminal liability arises for a crime against the public and public morality, and not against animal rights.

When organizing a kennel and breeding animals, it is necessary to remember the Code of Administrative Offenses - Article 6.4 of the Code of Administrative Offenses provides for a fine for violation of sanitary and epidemiological requirements for the operation of residential premises. SanPiN Sanitary and Epidemiological Requirements for Residential Buildings and Premises, approved by the Ministry of Health of the Russian Federation on December 15, 2000, prohibits owners and breeders from using residential premises for purposes not covered by project documentation to perform actions that are a source of elevated levels noise, vibration, air pollution, or violating the living conditions of citizens in neighboring residential premises, litter, pollute basements, stairwells and cells, attics and other places in common use.

In other words, if there are unpleasant odors in the apartment and constant cries of animals are heard, then the neighbors have every right to contact the SES. Also, residents of the house have the right to complain if a neighbor uncontrollably lets cats out for free-range, and they leave their marks in the entrance or other public place.

As a result of this check, a fine may be issued to the violator. It is also necessary to take into account the norms of regional legislation. For example, in Moscow there is a law “On penalties for violations of the laws of the Russian Federation in the field of animal welfare and temporary rules for keeping dogs and cats in the city of Moscow”.

The price of a thoroughbred kitten with a pedigree can range from one and a half thousand rubles to ten thousand dollars. The cost is determined, firstly, by the fashion of the breed in each particular country. Secondly, color. So in 2007, blue and silver were among the buyers at a high price, and among the breeders, the cinnamon color (cinnamon color) and the faun color (deer color). Thirdly, the type affects the price - modern or outdated. And fourthly, the kennel's fame, titles and victories of parents, the quality of previous litters.

The price of a kitten depends on the class. The “Show Class” is intended for exhibitions and breeding; these are the best representatives of their breed, carriers of its valuable and vivid signs. This class can only be confirmed at exhibitions. “Breed class” includes animals that for some reason themselves cannot become champions, but will give offspring of the “show class”. Everyone else belongs to the "pet class". They are bought exclusively for the home as a pet and are ready to love with all their “wrong” ears and noses.

The cattery is a generic nest, from where the breeder (owner of the cat) releases litters, registers the mating of animals and the birth of kittens. Each graduate of the nursery has a nickname for the next letter of the nursery (litters are issued with letters in alphabetical order) + the name of the nursery, this is the full name of the animal according to the documents. The breeder prolongs the activities of his nursery every year. The period of activity is a calendar year (from January 01 to December 31). If the breeder has not extended the nursery’s activities on time, then starting from January 1, the monthly cost of extending the nursery’s activities will increase by 100 rubles. If the breeder has not extended his activities until the end of the year (with fines), then on December 31 the cattery will be liquidated in the felinological system of professional PCA cat clubs, without the right to reinstate and re-membership.

Nurseries registered in the PCA system are not entitled to open nurseries in other felinological organizations. This is due to the peculiarities of breeding work on lines, dynasties and families, with the selection of high-quality livestock for promising work. The breeder should not have the opportunity to activate the rejected animals in those organizations where they do not require the animals to be sent to the club, where they only hand out documents of origin without seeing animals. We do not allow such an opportunity, therefore, we carry out breeding work in strict accordance with the current regulation on pedigree work.

To register a cattery in the PCA system, the cat owner submits an application to the organization with three variants of the cattery name (no more than 18 characters including spaces). A felinologist of the breed curator is allocated for coordination of work to help the breeder, for consultations, activating litters, representing the interests of the nursery at all levels.

If the breeder has completed felinological courses and issued more than 5 litters, then after an interview with the organization, the breeder can get permission to independently activate litters on the Internet with the felinologist curator of the breed.

The cattery in the remote cat breeding program is registered for free. In this program, the activities of the nursery are extended one year in advance from the moment the nursery is registered (the date is indicated in the Certificate for the nursery). Every year, the breeder prolongs participation in the program of remote breeding of animals, and thus the activity of the breeder’s cat nursery is extended.

Each breeder has the right at any time the nursery moves from one program to another. For example, you can transfer the nursery from a regular program (with a visit to the club) to a distance program (without visiting a club, surfing the Internet) and vice versa. For this, the breeder submits an application to the organization and switches to a convenient cat breeding program for him.

In the PCA system, the owner of the manufacturer also has the right to register a nursery. As a rule, this is done to create your own dynasty at the manufacturer or several manufacturers in the nursery. The owner of the cat can knit cats from various felinological organizations, pick up the "aliment" kitten with a copy of the cat’s pedigree and activate it in the system of professional PCA cat clubs and in the future, if desired, use the services of an advertising department.

Opening a cat’s cattery is the registration of its brand name, which cannot be changed or replaced, which will be used throughout the entire cattery’s activity and even after the cattery’s closure no one will name the cat’s cattery in this felinological system for another 20 years. The nursery cannot be registered twice per person.

Cattery can be given or bequeathed. In this case, the new owner of the nursery contacts the organization within a month and reissues the nursery for themselves (the application provides the original documents for the nursery).

In this case, it is not necessary to send an application for registration of a nursery from the site.During a visit to the club, a cattery registration form is filled out, the service is provided after payment of the annual fee for the cattery (2000 rubles) to the current members of APCLK cat clubs (see entry to APCLK).

3. Join the program of remote breeding cats "FREE-BREEDER" which includes a fee for registration of the cattery.
